US Court Orders Freedom of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her order.
The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling allegations, he was held in immigration detention.
In her order, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

The court proceedings involve disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing trial in the state of Tennessee.

The judge, who was overseeing his petition to removal in a Maryland district court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
